How to Fill Out the W8-Ben Form?

If you receive payments from the US, you may need to complete Form W-8BEN to prove that you are not a US citizen or resident and, therefore, not subject to the same tax rate as US citizens and residents.

To complete it, you will need to follow these steps:
Write the name of your company and select its entity type (e.g., private foundation, corporation, etc.).

Check the box that applies to your FATCA status (Foreign Account Tax Compliance Act). As a non-US entity, it would not classify as an "NFFE Asset." Entities with primarily passive income, such as dividends, interest, rents, royalties, etc., are usually included here.

Provide a registered address only if you are required to obtain GIIN. Insert "applied for" if your application for GIIN is still in progress. In such cases, GIIN has to be provided within 90 days.

Enter the registration code of your company. If the company is a tax resident of Estonia, write "ESTONIA" in paragraph 14(a), check the box in paragraph 14(b), and mark the "Company that meets the ownership and base" checkbox.

Check the box to certify that you meet all requirements, including the assets and passive income test described in the certification part. Passive income includes dividends, interest, rents, royalties, annuities, and other forms of passive income. Check the box to certify your status as a Passive NFFE.

Keep in mind:

If there is a change of circumstances, a new form must be submitted within 30 days.

The form must be signed by a duly authorized representative of the company.

Your full name should be in capital letters.

Add the signing date.
